Welcome to MintLeafCorner ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at mintleafcorner.sbs (the "Service") operated by MintLeafCorner.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
MintLeafCorner offers a range of premium yacht charter services, which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All offered activities are subject to availability and prevailing weather conditions. We may change or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a successful charter booking, you should:
- Be a minimum of 18 years old
- Ensure all provided information is correct and current
- Submit the specified deposit as highlighted in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A charter reservation is only secured after the payment is processed and you receive our confirmation in writing. We hold the discretion to reject service to anyone.
3.3 Availability
Our charters depend on yacht availability and favorable weather forecasts. We strive to accommodate your preferences for dates and times whenever possible.
4. Payment Terms
4.1 Pricing
We price all services in € and include taxes unless stated otherwise. Pricing can change without notification.
4.2 Payment Schedule
- Deposit: 50% of the total charter cost is due at the time of reservation
- Balance: This is payable 48 hours prior to the charter’s departure
- Incidental charges (if there are any): Payable after the charter service is rendered
4.3 Payment Methods
We accept various forms of payment including major credit cards, bank transfers, and certified cheques. We ensure secure and encrypted payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours notice prior to departure: Full refund minus processing fees
- Notice given 24-72 hours before departure: Refund of 50% of the total amount
- Less than 24 hours notice before departure: No refund will be issued
5.2 Weather Cancellations
If the captain deems weather conditions unsafe, we will either:
- Reschedule your charter to another available date free of additional charges
- Issue a full refund if rescheduling is not an option
5.3 Mechanical Issues
Should there be mechanical issues with your designated vessel, we will try to provide a comparable alternative. If that's not possible, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Passengers are required to:
- Abide by all instructions given by the crew
- Use the supplied safety equipment when necessary
- Inform us of any medical conditions that could impact their safety
- Stay within designated areas on the vessel
6.2 Prohibited Items
The following items are prohibited on board:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excessive amounts of beverages
- Pets (unless with prior permission)
6.3 Conduct
Passengers should behave respectfully. We may end a charter early and without a refund if a passenger's actions are unsafe or disturb others.
7. Liability and Insurance
7.1 Our Liability
We limit our responsibility to the amount you have paid for the charter. We aren't liable for:
- Injuries caused by a passenger's neglect
- Personal property loss or damages
- Indirect or punitive damages
- Delays due to weather or events outside our control
7.2 Insurance Coverage
Our vessels and business operations are covered by comprehensive marine insurance. You're advised to have your own personal and travel insurance.
7.3 Assumption of Risk
By partaking in our services, you acknowledge the inherent risks of maritime activities and assume full responsibility for your safety.
8. Modifications and Itinerary Changes
We reserve the right to alter itineraries, routes, or timetables depending on weather, safety or operational needs. We will endeavor to provide similar experiences when alterations occur.
9. Force Majeure
We hold no liability for alterations, delays, or cancellations due to events beyond our control, which include:
- Severe weather conditions
- Natural catastrophes
- Government directives
- Port interruptions
- Vehicular malfunctions
10. Privacy and Data Protection
We manage your personal details in line with our Privacy Policy. By utilizing our services, you permit your data to be processed as outlined in the Privacy Policy.
11. Intellectual Property
Our website content, comprising text, images, logos, and graphics, is protected by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our written consent.
12. Governing Law
These Terms are subject to the laws of Germany. Any legal matters will be settled in the courts of Hamburg, Germany.
